A practicing lawyer Reepak Kansal has written a letter to the Secretary General of the Supreme Court complaining about the pick and choose policy adopted by the registry with regards to listing of cases.
Advocate Kansal points out the discrimination practised by the Registry while listing of cases for hearing before the court. He further elucidates the matter by highlighting how Arnab Goswami’s petition was listed for hearing on the very next day of its filing. He further adds that this quick listing was done without pointing out any defects in the plea or urgency letter while a list of pending cases was ignored in the process.
Kansal alleges that this practise is not new to the court as such behaviour is a “routine” issue for the registry as it favours certain specific lawyers and law firms when it comes to listing of cases.
“It is routine in the Registry where some law firms/influenced advocates are given preference by the section officers/registry. This is discrimination and against the equal opportunity.”
He further points out that Goswami’s matter does not fall under “short category matters” as published by the Supreme Court earlier this month and yet, the same was listed for hearing within a few hours from being filed.
On the other hand, Kansal’s matter had been filed on April 17 and is yet to be listed and heard by the Apex Court despite having made several complaints to registry regarding the non-listing of his case.
The advocate has requested the Secretary General to take steps against such discriminatory practices.
