Bail on paying Rs 35,000 to PM CARES fund; download Aarogya Setu app: Jharkhand HC

Jharkhand HC granted bail to six convicts, convicted under Railways Act ordering them to pay 35,000 each to PM Cares fund and download Aarogya Setu app, immediately after being released from  custody.

An order was passed on Thursday by a Single Judge Bench of Justice Anubha Rawat Choudhary. The Court was told that the petitioners were willing to abide by any condition imposed for the grant of bail, including the deposit Rs. 35,000 each in the PM CARES fund and accordingly judged granted bail with the following additional conditions:

  • The petitioners shall show proof of payment of Rs. 35,000/-(Thirty Five thousand) each in the ‘Prime Minister’s Citizens Assistance and Relief in Emergency Situations(PM CARES) Fund’ before the learned court below prior to their release.
  • The petitioners shall download the ‘Aarogya Settu App’ immediately after being released from custody and shall abide by the directions of the Central Government as well as State Government issued in connection with containment of Covid-19 pandemic
  • The petitioners will submit self-attested copy of their Aadhar Card and also give their mobile number before the learned court below, which they will not change during the pendency of the case or without prior permission of the Court.

The petitioners were convicted and sentenced to undergo simple imprisonment for a period of 1 year each for the offence under Section 174 (a) Railways Act.

The petitioners contended:

The lower courts had not properly considered their case under the provisions of the Probation of Offenders Act while passing the sentence. The petitioners added that their acts were peaceful and there was no damage to any railway property as alleged.

The matter is posted for further hearing on July 8.
