The National Company Law Tribunal (NCLT) has decided to continue its status quo of hearing only unavoidable urgent cases as the lockdown was extended till May 3 on Tuesday.
Notice issued by NCLT reads,
“In view of the extension of lockdown announced by the Government of India until 03.05.2020,to curtail the spread of COVID19, the directions given in the notice dated 22.3.2020 issued by NCLT are hereby extended upto 03.05.2020. With regard to functioning of NCLT during Lockdown, the President, in addition to the earlier notices, will take further steps depending upon the exigencies of the litigant public and the same will be announced as and when any further decision is taken.”
The NCLT had initially notified the same via a notification dated 22nd March by which it had decided upon suspending its judicial work and taking up only urgent matters.
It had further informed that for getting unavoidable urgent matters listed, an application had to be filed via email to the registry NCLT Chennai after serving notice to the other side regarding the same. Subsequently, necessary orders would be passed by the Acting President.
It was also clarified that the parties/counsel would not be allowed to make oral submissions.
