The Supreme Court has issued notice to the Central Bureau of Investigation (CBI) over Uttar Pradesh legislator DP Yadav’s bail on medical grounds.
Yadav, who is serving life imprisonment in Dehradun jail for his connection with a murder, had been granted interim bail earlier in order to undergo spinal surgery at Yashoda Hospital and Research Centre in Ghaziabad. He had come back to jail post the procedure on 6 December, 2018.
In February 2019, he had filed another plea for interim bail on medical grounds which had been dismissed by a bench headed by former Chief Justice of India Ranjan Gogoi along with Justices Deepak Gupta and Sanjiv Khanna, wherein the Court directed the jail authorities to take the relevant steps according to law to ensure that Yadav’s medical needs were taken care of.

Today, a Bench headed by Justice L. Nageswara Rao took into consideration the documents of Yashoda Hospital which were submitted by Yadav’s Advocate, Vikram Chaudhari. Chaudhari further informed the Bench that as the State was opposing the Petition and the Bench sought to hear the stand of the State.
Accordingly, the Bench issued notice to the CBI.
The matter will now be taken up in the coming week.
Yadav had been awarded life imprisonment by a CBI Court in Dehradun in 2015 for his role in the murder of Mahendra Singh Bhati, an MLA from Dadri area of Ghaziabad who had been shot dead in December 1992.
