Delhi HC asks petitioner to approach DMRC on PIL seeking mandatory production of Identity Card while purchasing Metro Token/Card

Delhi High Court has asked petitioner seeking mandatory production of identity card or address proof while purchasing the token for Delhi Metro to make a representation before the Delhi Metro Rail Corporation regarding the same.

The Division Bench comprising of Justice Manmohan and Justice Sanjeev Narula directed the petitioner to make the said representation within 4 weeks after taking inputs from Centre as well as the Delhi Government.

In the present PIL, the Petitioner had sought court’s direction to mandate that the travellers of Delhi Metro Rail provide proof of their identities and addresses while purchasing Metro cards from Delhi Metro Rail Corporation.

The Petitioner had submitted that Delhi Metro Rail Corporation issued digital Metro cards or tokens to its customers, who in turn used it as travel coupons.

Therefore, it was argued that linking Metro card with the address proof of the travellers would protect the right to property, in case, the Metro card or token was lost.

It was further contended that the wake of ongoing COVID-19 pandemic, it was of utmost importance that the Respondents should be aware of the details of the passengers travelling by Delhi Metro as this would help in preventing a patient from travelling and could also be used in tracing the affected travellers in case a patient had unwillingly travelled in Delhi Metro.

While going through the submissions, the court noticed that no representation had been made by the concerned authority.

In light of the above, the court disposed of the petition by giving liberty to the Petitioner to make representation before DMRC.

The Petitioner in the case at hand was represented by Mr Rohit Mahawar.

Mr Tarun Johri appeared for the DMRC.
