[Tablighi jamaat] Plea in Delhi HC seeking immediate release of persons related to Tablighi Jamaat from quarantine centres

A plea has been moved in the Delhi High Court seeking immediate release of all persons related to Tablighi Jamaat, who have been kept in quarantine centres for more than 35 days.

The petition has been filed bySabihaQuadri who claims that continuous quarantine without any valid reason is an offense under sections 341 and 342 of the Indian Penal Code apart from being violative of Articles 14, 15 and 21 of the Constitution.

The Petitioner has highlighted that a total of 3288 persons who were associated with Tablighi Jamaat have been kept in different quarantine centres and have not been released despite the fact that they are in no manner infected.

It is also argued that some of these persons had also tested negative in three consecutive tests.

Adding to the above the petitioner argued that the continued period of quarantine of 37 days was in violation of the guidelines issued by the government which prescribe only 14 days of quarantine.

The petition for releasing of person related to Tablighi Jamaat stated,

‘The Delhi Government and the Sub Divisional Magistrate have failed to comply with their own guidelines.’

The Petitioner argued that the government’s approach in the present matter was arbitrary, malafide and malicious and could not sustain in a society which was governed by rule of law and principles of natural justice.

Alleging that the behaviour was violative of Article 15 the Petitioner said that the Delhi Government itself is discriminating against these persons on the grounds of religion.
