Allahabad High court committee has issued precautionary measures and preventive directions for the functioning of Subordinate Courts post nationwide lockdown extending till 15th April.
These measures are meant to act as a combating medium against COVID-19. All the measures would be followed by the subordinate courts, tribunals, Rehabilitation, Resettlement and Land Acquisition Authorities across Uttar Pradesh.
The Court noted that the status- quo shall prevail if the lockdown continues after 15th April.
The following directions were being issued by the Committee:
- Proper and assured sanitization of Court premises.
- Cases with final hearing, disposal, order, remand and bails shall be heard. Other matters shall be adjourned by the Presiding Officer.
- Matters agreed upon hearing without the presence of the parties shall be taken up by the courts.
- Written case arguments are mandatory for the disposal of cases by the advocates.
- Presiding officer shall decide at least two cases per day and can restrict the entry of parties in courtroom. But the Presiding officer is not allowed to prevent the appearance of any of the parties unless one is suffering from illness.
- Masks shall be used by everyone by following the rule of distancing. Sanitizers shall be kept at the entry of court room. Only 4 chairs are allowed in courtrooms for Advocates as per social distancing rule.
- A Gap of 10 minutes after every case shall be followed.
- Entry of public at large in the court campus will be restricted.
- District judges can use the mode of Video conferencing for disposal of cases.
