Additional Sessions Judgeof a Delhi Court has granted bail to DSP Davinder Singh who was suspended from the Jammu and Kashmir police force after being arrested while ferrying two Hizb-ul-Mujahideen terrorists in a vehicle on the Srinagar-Jammu Highway earlier this year.
Additionally, bail was also granted to accused Irfan Shahi Mir.
However, Davinder Singh will remain in prison as he is also undergoing judicial custody in a separate case of trying to terrorists to travel outside J&k, which is being probed by the National Investigation Agency (NIA).
The bail was granted by Additional Sessions Judge, Dharmender Rana since Delhi Police failed to file a chargesheet within the statutory period of 90 days.
As per the FIR, youths of Jammu & Kashmir and Punjab were being trained to carry out terrorist activities in the country and that there was a plan to execute terror attacks in Delhi.
The FIR apprehended the involvement of D-Company and ChhotaShakeel in funding a pro-Khalistan terrorist organisations in Punjab.
Before Court, counsel for Davinder Singh and Mir argued that he was entitled to be released on statutory bail as the 90-day period for filing a chargesheet was over.
In its status report before the Court, Delhi Police also stated that a chargesheet had not been filed as the investigation in the case was yet to be completed.
In view of the above, the Court ordered,
..considering the fact that despite the lapse of statutory time limit to complete investigation, chargesheet in the instant matter has not been filed till date, both the applicants/accused persons namely Davinder Singh and Irfan Sahfi Mir are entiled to be released on bail on furnishing PB/SB in the sum of Rs 1,00,000/- each with two sureties each in the like amount to the satisfaction of the Ld. MM/Ld Duty MM/Ld. CMM.Delhi Court
