Plea for Reconstitution of Inquiry Commission in Vikas Dubey Encounter Case in the SC On Grounds of Bias

An application seeking reconstitution of the inquiry commission has been filed before the Supreme Court to probe into the genuineness of the encounter killing of UP gangster Vikas Dubey.

On 21st July,the constitution of an inquiry commissionhad been approvedby the Supreme Court which was headed by Justice B S Chauhan, and comprised of former judge of Allahabad High Court, Justice Sashi Kant Agarwal and former UP Director General of Police, KL Gupta, to solve the matter.

Advocate Anoop Prakash Awasthi, the Applicant, urged to replace ex-DGP Gupta imputing allegations of bias with some other ex-DGP from the State.

Annexure of certain news reports was also given by the applicant where Mr. Gupta has expressly told the media that the police version of the encounter should be accepted on “face value”.

The plea on Vikas dubey encounter stated that, “The edifice of a just and fair investigation would shake if there is any real likelihood of Bias or reasonable suspicion of Bias.”

Submissions were made thata “remote likelihood of real bias” can vitiate the entire proceedings in an internationally recognized common law principle and therefore“to uphold the public confidence in the rule of law” the same was requested to the Apex Court in constitution of theCommittee.

Suggestions of names of Former DGPs Sh. IC Dwivedi, S. Jaweed Ahmed and Sh. Prakash Singh may be considered for this purpose.
